Hi,

In accordance with SSMA 2015 Section 106 (Duty of owners corporation to maintain and repair property),  and in compliance with Motion 19 at Annual General Meeting 2018 (strata affairs directly affecting Lot 158), it is requested that remediation work for pavers due to tripping hazard be completed as a matter of priority for five reasons:

a) Risk of tripping hazard (affecting our family and everybody else in SP52948) , as per undisclosed Napier & Blakeley professional report at cost of $12,144.00 (incl. GST) in July 2012.

b) Raised pavers generate continuous need for garden bed repairs at expense of Lot 158 (and other owners).

c) Delaying the repairs cause increase costs of maintenance and risk litigation due to failure of owners corporation to maintain and repair common property.

d) The tripping hazards were included in work required to be completed in 2018, as per 10-Year Capital Works Fund plan, commissioned in 2017.

e) Without legally valid reason, BCS Strata Management in 2016, and Waratah Strata Management in 2017 and 2018 failed to include Motion for this work in agenda for Annual General Meetings.
